Welcome to BriefMarkets. These Terms of Service ("Terms") govern your access to and use of the BriefMarkets platform, including our website, applications, and AI-powered research services (collectively, the "Service"). Please read these Terms carefully before using our Service.
By accessing or using BriefMarkets, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
1Description of Service
BriefMarkets provides AI-generated research briefs and analysis for prediction markets. Our Service aggregates publicly available data from third-party prediction market platforms, including but not limited to Polymarket and Kalshi, and utilizes artificial intelligence technology to generate market analysis and insights.
The Service is designed to provide informational content only. We do not operate a prediction market, facilitate trading, or provide financial advice.
2Eligibility
To use the Service, you must:
- Be at least 18 years of age
- Have the legal capacity to enter into a binding agreement
- Not be prohibited from using the Service under applicable law
- Not have been previously banned from the Service
3User Accounts
To access certain features of the Service, you must create an account. When creating an account, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Maintain the security and confidentiality of your login credentials
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized access or security breach
You may not share your account credentials or allow others to access your account. We reserve the right to suspend or terminate accounts that violate these Terms.
4Subscription Plans and Payment
BriefMarkets offers both free and paid subscription plans:
Free Tier
Limited access with up to 5 AI briefs total. No payment required.
Pro Subscription
Unlimited AI briefs and premium features. Billed monthly ($29/month) or annually ($199/year).
Payment Terms
- All payments are processed securely through Stripe
- Subscriptions automatically renew at the end of each billing period
- You may cancel your subscription at any time through your account settings
- Refunds are available within 14 days of initial purchase for new subscribers
- Price changes will be communicated at least 30 days in advance
5Acceptable Use Policy
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Service for any illegal or unauthorized purpose
- Attempt to gain unauthorized access to any part of the Service
- Interfere with or disrupt the Service or its infrastructure
- Scrape, crawl, or collect data from the Service without permission
- Use automated systems to access the Service in a manner that exceeds reasonable use
- Redistribute, resell, or commercially exploit our content without authorization
- Impersonate any person or entity or misrepresent your affiliation
6Intellectual Property Rights
The Service and its original content, features, functionality, and branding are and will remain the exclusive property of BriefMarkets and its licensors. The Service is protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes in accordance with these Terms.
Market data displayed on our platform is sourced from third-party providers and remains the property of those respective providers.
7Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee the accuracy, completeness, reliability, or timeliness of any information provided through the Service. AI-generated content may contain errors or inaccuracies. Market data may be delayed or incomplete. You use the Service at your own risk.
8Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRIEFMARKETS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF THE SERVICE.
Our total liability to you for any claims arising from or relating to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
9Indemnification
You agree to indemnify, defend, and hold harmless BriefMarkets and its officers, directors, employees, contractors, and agents from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from or relating to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
10Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:
- Breach of these Terms
- Fraudulent or illegal activity
- Non-payment of applicable fees
- Requests by law enforcement or government agencies
Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
11Changes to Terms
We reserve the right to modify or replace these Terms at any time at our sole discretion. If we make material changes, we will provide notice through the Service or by email at least 30 days before the changes take effect. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
12Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
Any disputes arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
13Severability
If any provision of these Terms is held to be unenforceable or invalid, such provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
